Definitions
Productionscene.com – The website to which this document pertains which is owned by Media AGE Co Ltd, a registered company in Thailand.  In the context of this document, “Productionscene.com” refers to and includes all its directors, employees, divisions, subsidiaries, agents, affiliates and representatives.

User – Any individual, entity or company making use of services, content, functionality and features as provided on Productionscene.com whether they are registered users of the site or otherwise.

General
Productionscene.com functions as a public access interactive content portal specifically for the Film, Stage, TV, Video, Live Events, Media (online media, digital media & print media) & Entertainment Industries.  We offer Users the means to upload listings and profiles including images and video and to post articles, press releases, job offers, classifieds and casting calls for the purpose of marketing and promoting their services and products.  Productionscene.com’s functions and services include both free and paid for options.

By using ProductionScene.com you agree to the following Terms and Conditions of Site Usage that governs all content within the site including images and video and international copyright laws therein as well as memberships and account usage and interaction between site users, members and all listings.

Productionscene.com is not a link directory.  While Premium Membership packages do provide a link to a Users website the onus is on promoting talents and services within the portal and on creating an interactive environment.   A Membership Account enables users to contact other users and be contacted via email.  At no time is a Users / Members email address displayed or published by Productionscene.com.

Content Accuracy
Productionscene.com is a fully managed site which actively moderates all submitted material before publishing.  Ostensibly this is an anti spam measure but we also work hard to ensure the accuracy of links and information supplied by site users.  Please notify Productionscene.com in writing should you object to information found within the site or discover discrepancies, irregularities and inaccuracies. 

User Generated Content on Productionscene.com is for informational purposes only.  ProductionScene.com makes no performance guarantees and accepts no liability whatsoever for services or goods being offered by 3rd parties (Site Users, Site Members and all associated content, material and information that they may post, market and advertise) on ProductionScene.com.  Nor does ProductionScene.com vouch for or endorse any services or products listed on the site and makes no guarantee of the authenticity of listings or their alleged credentials.

Before transacting with any entity found on ProductionScene.com for products or services advertised we strongly recommend that you exercise due diligence before becoming committed by contract or otherwise to any individual, entity, product or service featured on Productionscene.com.

While Productionscene.com takes measures to moderate the content on the site as part of the overall service being offered we are not under any obligation to actively “Police” the content nor are we obliged to confirm the accuracy of content and material posted by a “User” to Productionscene.com.

Services & Crew Listings (Basic / Premium)
Basic Profile – A basic profile is currently free of charge on Productionscene.com and offers the opportunity to add a logo or leading image to your profile, pinpoint your location with Google Maps, associate yourself with a single category, upload 2 further images, one video and 3 attached files (Resumes, Credits, etc).  Users must register an Account on Productionscene.com to qualify for a basic profile and the subscription period is for one year and can be renewed or upgraded.  Basic Listings do not include a Link to you Website field and links placed within profiles submitted for moderation will be removed by Productionscene.com.

Premium Profile – This is a paid annual subscription which provides account holders with a broad repertoire of features and an enhanced listing.  Your images are larger, your profile is highlighted and more noticeable.  Features include: full contact information, Email and a link to your website, product and service descriptions, association with 6 categories, Google Maps, credits, clients, and jobs, associations/organizations, a portfolio of 10 images and 10 videos as well as the option to upload up to 50 file attachments as well.  Premium Profiles offer access to our Articles and Press Release Service enabling subscribers to this category to upload and feature as many articles and press releases as required.

All profiles submitted for inclusion in Productionscene.com are subject to review, a process free of time limitation.  Productionscene.com reserves the right to reject all or part of any profile submitted, paid or otherwise.  Only profiles relevant to the industry sectors within Productionscene.com will be considered.  Productionscene.com reserves the right to adjust its rate card and subscription fees at any time and without prior notice. 

Violation or abuse of this Agreement and Site Terms may result in Account Termination.  In the event of this occurrence, a Terminated Account immediately losses all privileges and forfeits any an all existing or current payments and subscriptions.

Classifieds
Productionscene.com provides a classifieds section designed to create a market place for buyers and sellers where related equipment (both new and used), products and services can be advertised.  Productionscene.com is the provider of this facility only where adverts can be placed for a fixed rate.  We do not provide information about products and services featured, endorse products and services featured, vouch for legitimacy or verify the authenticity of any advert placed within the Classifieds section of Productionscene.com.  In all instances, negotiation is between the buyer and the seller directly.

When responding to classified adverts placed on Productionscene.com we recommend Users to exercise due diligence treating the advert and vendor with the same caution that one would normally exercise when responding to classifieds in a newspaper. 

From time to time Productionscene.com might publish links to 3rd party vendor sites which carry products which we believe may be of interest to our users.  In such cases, these sites are managed and operated independently from Productionscene.com and we cannot be held responsible nor do we make any guarantees of, but not limited to, pricing, quality, reliability of any products or services featured on such 3rd Party sites and recommend that when exploring such links Users first read all Privacy Policies and Terms of the 3rd Party site in question prior to engaging in any interaction or transaction with the site. 

Non-compliance to these Terms and inappropriate use of Productionscene.com’s Classifieds Service may result in Account Termination.  Productionscene.com reserves the right to reject inappropriate classified adverts submitted to the site for inclusion in the Classifieds Section and to terminate a Members Account incase of violation of any terms described in this document at its sole discretion.

Articles & News
Productionscene.com offers Users a comprehensive Article and Press Release facility which, until further notice, is operated as a free service.  While there is no limit to the amount of Articles or Press Releases that an individual can submit all submissions are moderated by Productionscene.com and we reserve the right to reject or edit submissions that we deem inappropriate, irrelevant, sub standard or un-newsworthy. 

Productionscene.com reserves the right to introduce fees for this service at any time and without prior notice.  Previously published Articles and Press Releases that were submitted and published during the free period will continue to be exempt from any fees implemented for the duration of the subscription period.

At no time can Productionscene.com be held responsible for articles and press releases posted by Users of the site that commit copyright infringement.

Jobs
Productionscene.com provides a Job Section for users to post Situations Vacant and Job Opportunities that may be on a full time, part time, temporary, on a contractual basis etc.  As with all submitted content and material to Productionscene.com job offers are moderated before being published.  However, Productionscene.com does not screen employers who post job offers on the site and cannot control the quality, safety, legality, authenticity or accuracy of jobs and opportunities being offered by 3rd Parties placing Job Offers and Opportunities on Productionscene.com. 

Productionscene.com reserves the right to reject and/or delete any Job Offers submitted to the site that are deemed inappropriate, irrelevant or suspicious.  Productionscene.com reserves the right to Terminate a Users / Members Account without prior notice for misuse of the jobs service and shall do so entirely at its own discretion and without refund.

Castings
Productionscene.com provides a “Casting Calls” Section for users to post and advertise upcoming Casting Calls.  This section is specifically targeted at professional Actors and Actresses.  Upcoming opportunities for individuals who are not professional actors and actresses should be posted in the “Jobs” section and all submitted Casting Calls for individuals who are not professional actors and actresses will be redirected by Productionscene.com to the “Jobs” Section at their discretion.

As with all submitted content and material to Productionscene.com, Casting Calls are moderated before being published.  However, Productionscene.com does not screen entities posting Casting Calls on the site and cannot control the quality, safety, legality, authenticity or accuracy of Casting Calls being offered by 3rd Parties on Productionscene.com. 

Productionscene.com reserves the right to reject and/or delete any Casting Calls submitted to the site that are deemed inappropriate, irrelevant or suspicious.  Productionscene.com reserves the right to terminate a Users / Members Account without prior notice for misuse of the Casting Calls service and shall do so entirely at its own discretion and without refund if the Account Member is found to have violated these terms, abused the system or been fraudulent in any way.

Cancellations
Should you wish to cancel a Premium (paid for) Subscription for an existing subscription package that you have on Productionscene.com you must do so prior to the renewal date.  You will receive automated emails from ProductionScene.com reminding you that your package is about to expire.  Account holders are responsible for cancelling their subscriptions through PayPal prior to the renewal date.  ProductionScene.com is not responsible for past or future billings if an Account Holder and Member has failed to cancel a paid subscription:

Refund Policy
ProductionScene.com operates a no-refund policy.  The nature of the internet and our website provides immediate access complete with all services described within the rate card.  Users can Contact Us prior to purchasing a Premium Subscription package for any further information and confirmations required about the package and once your transaction has been processed and confirmed by PayPal you have unrestricted access to all pre-confirmed features.

Contacting Individuals & Entities Listed on ProductionScene.com
Productionscene.com provides registered users with the means to contact profiles, listings and advertisers featured on the site.  Registered Users are authorized to use this email contact service only if the intend to purchase or engage the services of companies, products or individuals featured on the site. 

Users are not permitted under any circumstance to use the internal email system for solicitation purposes including, but not limited to, trying to sell a product or service, direct selling / marketing attempts, requesting employment from a listed individual or company, pitching an idea or concept or any form of lewd or abusive behaviour towards an individual or entity featured on Productionscene.com.

Productionscene.com nor its subsidiaries, divisions, affiliates, agents, representatives or licensors make no representation as to the legitimacy of any individual or entity featured on the site and shall not be liable to anyone for any loss, injury, direct or indirect, incidental, consequential, special, punitive, or similar damages arising from information received or sent, either directly or indirectly through the messaging system.

A User / Member Account will be terminated immediately and without notice or refund for misuse of the email service at the sole discretion of Productionscene.com.

Email Addresses
Productionscene.com operates a strict policy where handling of clients email addresses are concerned to ensure that Users privacy is not violated (see Privacy Policy).  Although we do collect email addresses upon registration user email addresses are never made public through the system.  Where email addresses are posted within User submitted content of any description it is contrary to the policies of this website and done so in absence of approval from Productionscene.com.

Content Use
All content featured on Productionscene.com including but not limited to the text, software, scripts, graphics, photos, sounds, music, videos, search engine optimization techniques, categories, interactive features and the like ("Content") and the trademarks, service marks and logos contained therein ("Marks"), are owned by or licensed to Productionscene.com, subject to copyright and other intellectual property rights under the law.

All content with Productionscene.com is provided to site users on an AS IS basis and is for informational and personal use only.  Users may not download copy, reproduce, transmit, distribute, broadcast, display, license, sell, or otherwise exploit the content for any other purposes whatsoever without the prior written consent of the respective owners. Productionscene.com reserves all rights not expressly granted in and to the Website and the Content.

Users may access Content, Videos and other content related material found on Productionscene.com only as permitted under this Agreement.  Users agree to not engage in the use, copying, or distribution of any of the Content other than expressly permitted herein, including any use, copying, or distribution of User Posts of third parties obtained through the Website for any commercial purposes.

Users agree not circumvent, disable or otherwise interfere with security-related features of Productionscene.com or features that prevent or restrict use or copying of any Content or enforce limitations on use of Productionscene.com or the Content therein.

Users understand that when using Productionscene.com, they will be exposed to information and videos (content) from a variety of sources, and that Productionscene.com is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such User Postings.

Users further understand and acknowledge that they may be exposed to User Postings that are inaccurate, offensive, indecent, or objectionable, and agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against Productionscene.com with respect thereto, and agree to indemnify and hold Productionscene.com, its Owners/Operators, affiliates, and/or licensors, harmless to the fullest extent allowed by law regarding all matters related to your use of the site.

User Generated Content: “User Postings”
A registered account with Productionscene.com entitles Users to upload profiles and listings, upload images and videos, post Casting Calls, Articles, Press Releases, Classifieds and Job offers which are collectively referred to as “User Postings”.  The User understands that by submitting “User Postings” and whether the User Posting is published or not, Productionscene.com makes no guarantees of confidentiality.

The user is solely responsible for their User Postings and any consequences that transpire from posting or publishing them.  When submitting User Postings to Productionscene.com the User affirms, represents, and guarantees that they own or have the necessary licenses, rights, consents, and permissions to use all content and material included within.

License #1:  User authorises Productionscene.com to use all patents, trademarks, trade secrets, copyrights or other proprietary rights included within and as per the Terms of this User Agreement.  

License #2:  User retains all ownership of Content and Material in their User Postings but grants Productionscene.com a worldwide, non-exclusive, royalty-free, sub-licensable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Postings in connection with Productionscene.com, its successors' and affiliates', including without limitation for promoting and redistributing part or all of Productionscene.com (and derivative works thereof) in any media formats and through any media channels.

License #3:  User hereby grants each user of Productionscene.com a non-exclusive license to access their User Postings through the Productionscene.com, and to use, reproduce, distribute, display and perform such User Postings as permitted through the functionality of the Website and under these Terms of Service..

The above licenses granted by you in User Comments are perpetual and irrevocable.  In the event that User deletes or removes User Posting content from their account on Productionscene.com User understands and agrees that Productionscene.com may retain, but not display, distribute, or perform, server copies of removed or deleted User Postings.

User agrees not to submit User Postings that contain material that is copyrighted by an entity other than themselves, protected by trade secret or otherwise subject to third party proprietary or restrictive rights, including privacy and publicity rights.  User agrees to only submit User Postings that contain material wholly owned by themselves, or that they own the rights to or that they have previously obtained permissions from the rightful owner; permissions that extend to Productionscene.com complete with licensing rights therein.

Productionscene.com does not endorse any User Postings or User Generated Content found on the site to include but not limited to opinions, recommendations, viewpoints, or advice expressed therein.  Productionscene.com expressly disclaims any and all liability in connection with User Postings and does not endorse or permit copyright infringement of intellectual property rights on its Website.

Upon receipt of notification that Content or User Postings featured on Productionscene.com infringe on intellectual property rights of a 3rd party, Productionscene.com shall remove such Content and User Postings immediately and reserves the right to do so in absence of prior notice.

Account Termination
Violation of Terms:  Productionscene.com reserves the right to terminate and block a User’s access for violation of our sites Terms and Conditions. 

Inappropriate Content:  Productionscene.com reserves the right to decide whether submitted content, including listings and profiles, images, video, casting calls, job offers, articles and press releases, is appropriate and relevant to the site.  Content deemed inappropriate or irrelevant by Productionscene.com and its associates will not be published.  Where submitted content is blatantly irrelevant the User may be blocked from the site and their account terminated indefinitely or irrevocably.

Images, Video & Nudity – Productionscene.com does not permit sexually explicit images to be featured on the site.  Sexually explicit images include but are not limited to images of sexual intercourse, obvious states of sexual arousal (erections), or overt sexual positions (such as noticeably visible or spread genitalia).  Photographers and Models who wish to feature nudity within their published portfolios may do so providing that the featured content is tasteful, legal, inoffensive and free from copyright infringement. 

Submissions are moderated by Productionscene.com who reserves the right to remove images and disable member’s accounts for failing to adhere to these terms and guidelines therein.   Consistent misclassification (rating) or categorization of images may result in the forced setting of ratings and in gross violations may result in Account Termination.  The definition of what is and what is not tastefully appropriate is at the sole discretion of Productionscene.com.

Copyright Infringement:  In all cases, the liability for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm caused by a User of Productionscene.com uploading and using copyrighted material without first obtaining written consent from the owner is the Users and the person named as the Account Holder.  Registered Members and Users of Productionscene.com are entirely responsible for determining the copyright status of content and material that they wish to feature via their account and for obtaining any necessary permissions from copyright owners before submitting the content for review by Productionscene.com. 

Where it is brought to our attention that a user has committed a copyright infringement via their account on Productionscene.com, we reserve the right to delete such content and material immediately and without notice to the Account Holder.  Productionscene.com shall not be liable for such copyright infringements and will support the plaintiff in all cases of proven copyright infringement and reserves the right to terminate a member’s account where serious copyright infringement offences have been committed.

Site Users agree to refrain from posting information or correspondence that is not of a professional nature or which contravenes US Federal, and International Trademark or copyright laws and restrictions in any way.

Other Violations:  Other violations that may result in account termination include but are not limited to pornography, obscene or defamatory material, or general abuse of the system and the privileges afforded through site membership.

ProductionScene.com reserves the right to terminate a Users / Members Account at any time, without prior notice and at its sole discretion.

Terms of Use
Users agree to use Productionscene.com in a responsible and professional manner and for lawful purposes only and shall not post or transmit through Productionscene.com any material which violates or infringes in any way upon the rights of others, which is unlawful, abusive, threatening, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law, or which, without Productionscene.com's express prior approval, contains advertising or any solicitation with respect to products or services. Any conduct by a user that in Productionscene.com's discretion restricts or inhibits any other user from using or enjoying Productionscene.com will not be permitted.. 

User shall not use Productionscene.com to advertise or perform any commercial solicitation, including, but not limited to, the solicitation of users to become subscribers of other on-line information services competitive with Productionscene.com.

Productionscene.com contains copyrighted material, trademarks and other proprietary information, including, but not limited to, text, software, photos, video, graphics, music and sound.  All content within Productionscene.com is copyrighted under International copyright laws. Productionscene.com owns a copyright in the selection, coordination, arrangement and enhancement of such content, as well as in the content original to it.

User may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the content, in whole or in part. This includes Service and Crew profiles and listings, Classifieds, Casting Calls, Jobs and all other content on Productionscene.com with the exception of News & Articles which may be republished and transmitted subject to the “Publishing Guidelines” and conditions therein which are posted at the footer of each Article and Press Release.

User may download copyrighted material for their personal use only. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without the express permission of Productionscene.com and the copyright owner.

Where permissions have been expressly granted by Productionscene.com to copy, redistribute or publish copyrighted material (i.e. Articles and Press Releases), no changes in or deletion of author attribution, trademark legend or copyright notice shall be made. User acknowledges that they do not acquire any ownership rights by downloading copyrighted material.

User shall not upload, post or otherwise make available on Productionscene.com any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right.  It is entirely the responsibility of User to ascertain the copyright status of material and content that they wish to include in User Postings and other submissions prior to submitting the content for review to Productionscene.com.

User shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission.

In submitting content to Producionscene.com, User automatically grants, or warrants that the owner of such material has expressly granted Productionscene.com the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate and distribute such material (in whole or in part) worldwide and/or to incorporate it in other works in any form, media or technology now known or hereafter developed for the full term of any copyright that may exist in such material.

User permits any other user to access, view, store or reproduce the material for that user's personal use. User hereby grants Productionscene.com the right to edit, copy, publish and distribute any material made available on Productionscene.com by that user.

The foregoing provisions are for the benefit of Productionscene.com, its subsidiaries, affiliates and its 3rd party content providers and licensors and each shall have the right to assert and enforce such provisions directly or on its own behalf.

No Warranties
Productionscene.com is provided for public use without warranties of any kind, whether expressed, implied or statutory including but not limited to, any implied warranty of merchantability, fitness of the service for a particular purpose and non-infringement of any third party rights. Productionscene.com makes no warranty of any kind, expressed or implied, regarding the quality, accuracy, or validity of the data and/or information sent or accessed through its site or that the service will be error free.

Limitation of Liability
Productionscene.com, associated companies, its subsidiaries, directors, employees or affiliates shall under no circumstances be liable for any indirect, incidental, special, punitive or consequential damages (including, without limitation, lost profits) whether or not foreseeable, that result in any way from Users use of or inability to use the service or the equipment obtained through the service, or customer's reliance on information provided, or that result from mistakes, omissions, interruptions, deletions or any failure of performance, even if Productionscene.com has been advised of the possibility of such damages.

In all cases, Productionscene.com’s entire liability under or existing out of this agreement is limited to the sum total of payments made by customer to Productionscene.com during the six months immediately preceding the event for which damages are claimed. No action or proceeding against Productionscene.com may be commenced more than one (1) year after the service giving rise to the claim is rendered.

Indemnification
As the site “User” you are entirely responsible for and indemnify and hold harmless ProductionScene.com and all its divisions, subsidiaries, agents, affiliates and representatives against any claim or legal proceeding that may arise based on the material and content that you post on Productionscene.com or transmit via the site.

User agrees to indemnify, defend and hold Productionscene.com, its subsidiaries, directors, employees and affiliates harmless from any claims, losses or damages, including legal fees, relating to any violation of this agreement by customer or placement of or transmission of any message, information, software or other materials on the internet by customer or user authorised by customer to do so. This indemnification shall survive the termination of the agreement.

Changes & Modifications to Terms of Use
Productionscene.com retains the right to change and/or modify the contents of this document (Terms of Use) and when doing so shall offer 30-days notice by means of notification within the site Terms.

The Service and the Site contain information, facts and opinions from various individuals and organizations. THE SERVICE AND THE SITE ARE PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPOSED BY AND INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION UNDER THE LAWS APPLICABLE TO THIS AGREEMENT. NEITHER PRODUCTIONSCENE.COM NOR ITS AFFILIATES ENDORSE OR ARE RESPONSIBLE FOR THE ACCURACY OR RELIABILITY OF ANY OPINION, PROFILE, ARTICLE, PRESS RELEASE, CASTING, JOB OFFER, ADVICE OR STATEMENT ON THE SERVICE OR THE SITE.
